General Terms and Conditions of Racionesmilitares.com

These Terms regulate

·         the use of Racionesmilitares.com, and,

·         any other related contracts or legal relationships entered into with the Owner

in a legally binding manner. Capitalized words are defined in the specific corresponding section of this document.

Users should read this document carefully.

Unless otherwise specified, the terms of use detailed in this section will generally apply to the use of Racionesmilitares.com.

In specific situations, individual or additional terms of use or access may apply, and in such cases, they will be additionally indicated in this document.

By using Racionesmilitares.com, Users confirm that they meet the following requirements.

·         There are no restrictions regarding Users being Consumers or Professional Users;

Account suspension and deletion

The Owner reserves the right, at its sole discretion, to suspend or delete User accounts at any time and without prior notice, if they are deemed inappropriate, offensive, or in violation of these Terms.

The suspension or deletion of User accounts will not entitle Users to demand any compensation, damages, or refunds.

The suspension or deletion of accounts due to causes attributable to the User will not exempt said User from paying applicable fees or prices.

Unless otherwise specified or clearly recognizable, all content available on Racionesmilitares.com is owned by the Owner or provided by the Owner or its licensors.

The Owner undertakes to act with the utmost diligence to ensure that the content provided on Racionesmilitares.com does not infringe any legal provisions or violate the rights of third parties. However, it will not always be possible to achieve this objective.
In such cases, without prejudice to the legal prerogatives available to Users to enforce their rights, Users are requested to communicate complaints in this regard using the contact details provided in this document.

The Owner reserves all intellectual property rights over all such content.

Consequently, Users may not use such content in ways that are not necessary or implicit in the proper use of the Service.

·         Offending the Owner or any third party.

TERMS AND CONDITIONS OF SALE

Paid products

Some of the Products provided on Racionesmilitares.com, as part of the Service, are provided in exchange for consideration.

The fees, duration and conditions applicable to the purchase of such Products are described below and in the specific sections of Racionesmilitares.com.

Product description

Prices, descriptions or availability of Products are detailed in the corresponding sections of Racionesmilitares.com and may change without prior notice.

Although the Products on Racionesmilitares.com are presented with the highest possible fidelity from a technical point of view, the representation on Racionesmilitares.com through any means (including, as appropriate, graphic materials, images, colors or sounds) is only intended as a reference and does not imply any guarantee of the characteristics of the purchased Product.

The characteristics of the chosen Product will be described during the purchase process.

Purchase process

All steps taken from the choice of a Product to the submission of the order are part of the purchase process.

The purchase process includes the following steps:

·         Users must choose the Product they want and check their purchase selection.

·         After reviewing the information shown in the purchase selection, Users may place the order by submitting it.

Order submission

When Users place an order, the following clauses apply:

·         Placing an order determines the conclusion of the contract and therefore obliges the User to pay the price, taxes and all possible customs duties arising from the purchase. Racionesmilitares.com is not responsible for the payment of taxes and duties required from the buyer for delivery. 

·         In the event that the purchased Product requires an action on the part of the User, such as providing information or personal data, specifications or special wishes, placing the order will oblige the User to cooperate in this regard.

·         Once the order has been placed, Users will receive a receipt confirming its reception.

All notifications regarding the purchase process described will be sent to the email address provided by the User for this purpose.

Prices

Users will be informed, during the purchase process and before the order is sent, of all commissions, fees, and costs (including, where applicable, shipping costs) that must be paid.

Prices on Racionesmilitares.com are displayed:

·         either including or excluding all applicable commissions, fees, and costs, depending on the section the User is consulting.

Offers and discounts

The Owner may offer discounts or make special offers for the purchase of Products. All such offers or discounts will in any case be subject to the admission criteria and the terms and conditions established in the corresponding section of Racionesmilitares.com.

Offers and discounts are always granted at the sole discretion of the Owner.

Repeated or recurring offers or discounts will not create any action or right that Users may exercise in the future.

Depending on each case, discounts or offers will only be valid for a limited time or while supplies last. If an offer or discount is time-limited, the temporal parameters will refer to the Owner's time zone, as indicated in the Owner's location data in this document, unless otherwise stated.

Coupons

Offers or discounts may be based on Coupons.

If there is a breach of the conditions applicable to the Coupons, the Owner may legitimately refuse to fulfill its contractual obligations and expressly reserves the right to take appropriate legal action to protect its rights and interests.

Without prejudice to the provisions set forth below, additional or divergent rules applicable to the use of the Coupon appearing on the corresponding information page or on the Coupon itself will prevail in all cases.

Unless otherwise stated, the following rules apply to the use of Coupons:

·         Each Coupon will be valid only when used in the manner and within the period specified on the website and/or on the Coupon;

·         Only one Coupon can be applied, in its entirety, at the time of purchase - partial use is not allowed;

·         Unless otherwise stated, single-use Coupons can only be used once per purchase and therefore can only be applied on a single occasion even in cases referring to purchases based on installment payments;

·         Coupons cannot be cumulatively applied;

·         Coupons can only be redeemed within the period specified in the offer. After this period, the Coupon will automatically expire, preventing any possibility for the User to claim the corresponding rights, including its exchange for cash;

·         Users will not be entitled to any credit/refund/compensation in case of a difference between the value of the Coupon and the redeemed value;

·         Coupons are intended for non-commercial use only. Any reproduction, falsification, and commercialization of Coupons, along with any illegal activity related to the purchase and/or use of Coupons, is strictly prohibited.

Payment methods

Information regarding accepted payment methods will be provided during the purchase process.

Some payment methods will only be available subject to additional conditions or fees. In such cases, information related to these can be found in the specific section of Racionesmilitares.com.

All payments are processed independently through third-party services. Therefore, Racionesmilitares.com does not collect any payment information - such as credit card data - but only receives a notification once payment has been successfully completed.

If payment fails through the available methods or is denied by the payment service provider, the Owner will have no obligation to execute the purchase order. If a payment fails or is denied, the Owner reserves the right to claim from the User all expenses or damages related thereto.

Installment payment of the price

Payment of the purchase price may be made in two or more installments, within the periods established on Racionesmilitares.com or otherwise communicated by the Owner.
Specific Products may be excluded from this payment model.
If the User fails to meet any of the payment deadlines, the entire remaining amount will immediately be considered due, liquidated, and enforceable.

Authorization for future payments via PayPal

If Users authorize the PayPal functionality that allows for future payments, Racionesmilitares.com will store an identification code linked to the User's PayPal account. This will authorize Racionesmilitares.com to automatically process payments for future purchases or for recurring installment payments of past purchases.

This authorization may be revoked at any time, either by contacting the Owner or by modifying the user settings offered by PayPal.

Retention of title to the Product

Until the Owner has received full payment of the purchase price, the User will not acquire ownership of the Products subject to the order.

Delivery

Deliveries will be made to the address indicated by the User and in the manner specified in the order summary.

Upon delivery, Users must check the contents of the delivery and notify any anomaly without undue delay, using the contact details indicated herein or as described in the delivery note. Users may refuse to accept the package if it is visibly damaged.

Goods are delivered to the countries or territories specified in the corresponding section of Racionesmilitares.com.

Delivery times are specified on Racionesmilitares.com or during the purchase process.

Failed delivery

The Owner shall not be liable for delivery errors due to inaccuracies or the User's failure to complete the purchase order, nor for any damage or delay occurring after delivery to any carrier organized by the User and not offered or recommended by the Owner.

If the goods are not received or collected at the specified time or within the specified period, the goods will be returned to the Owner, who will contact the User to arrange a second delivery attempt or to agree on how to proceed in the future.

Unless otherwise agreed, any delivery attempt after the second will be at the User's expense.

User Rights

Right of withdrawal

Unless an exception applies, Users may withdraw from the contract within the period indicated below (usually 14 days), for any reason and without justification. Users can obtain more information on the conditions of withdrawal in this section.

To whom the right of withdrawal applies

Unless an applicable exception is mentioned below, Users who are European Consumers enjoy a statutory right of cancellation under EU law, which allows them to withdraw from online contracts (distance contracts) within the indicated period applicable to their case, for any reason and without justification.

Users who do not fall into this category will not be able to enjoy the rights described in this section.

Exercise of the right of withdrawal

To exercise the right of withdrawal, Users must send the Owner an unequivocal statement of their intention to withdraw from the contract.

To this end, Users may use the model withdrawal form provided in the "definitions" section of this document and send it by email to info@racionesmilitares.com or to the address Plaza Neptuno 6.11100 San Fernando, Cádiz. Spain. 

However, Users are free to express their intention to withdraw from the contract by making an unequivocal statement in any other appropriate way. In order to comply with the deadline for exercising this right, Users must send the withdrawal notification before the withdrawal period expires.

When does the withdrawal period end?

·         Regarding the acquisition of goods, the withdrawal period will expire 14 days from the day on which the User or a third party – other than the carrier and indicated by the User – takes physical possession of the goods.

·         Regarding the acquisition of several goods ordered in the same order but delivered separately or in the case of the acquisition of a single good consisting of multiple components or parts delivered separately, the withdrawal period will expire 14 days from the day on which the User or a third party – other than the carrier and indicated by the User – acquires physical possession of the last good, component, or part.

Effects of withdrawal

The Owner will reimburse Users who properly withdraw from a contract all payments made to the Owner, including, where applicable, those used to cover shipping costs.

However, additional costs arising from the choice of a specific shipping method other than the least expensive standard shipping method offered by the Owner will not be reimbursed.

Said reimbursement will be made without undue delay and, in any case, within a maximum of 14 days from the day on which the Owner is informed of the User's decision to withdraw from the contract. Unless otherwise agreed with the User, reimbursements will be made using the same payment methods used to process the initial transaction. In any case, the User will not incur any costs or fees as a result of said reimbursement.

…on the acquisition of tangible goods

Unless the Owner has offered to collect the goods, Users must send the goods back or hand them over to the Owner, or to a person authorized by the latter to receive the goods, without undue delay and in any case within 14 days from when they communicated their decision to withdraw from the contract.

The deadline will be deemed to have been met if the goods are delivered to the carrier or otherwise returned as indicated above, before the expiration of the 14-day period for the return of the goods. Reimbursement may be withheld until the goods are received or until Users have provided proof that they have returned the goods, whichever occurs first.

Users will only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics, and functioning.

The costs of returning the goods will be borne by the User.
